Veteran Asphalt LLC
Applicable to All Estimates, Proposals, and Work Agreements
These Terms and Conditions are incorporated into all estimates, proposals, and agreements issued by Veteran Asphalt LLC (“Veteran Asphalt,” “Contractor”), whether attached or referenced.
By approving a Veteran Asphalt estimate, proposal, invoice, or scheduling service, the customer confirms receipt of and agreement to all Terms & Conditions outlined below.
GENERAL TERMS
These terms apply to all services performed by Veteran Asphalt LLC, including but not limited to asphalt sealcoating, crack filling, asphalt maintenance, surface preparation, and related asphalt services.
- Scope of Work
All work is limited strictly to the scope defined in the accompanying estimate or proposal. Any items not specifically listed are excluded unless added through a written change order approved by both parties.
Recommendations declined by the customer may be noted on the estimate. Veteran Asphalt shall not be responsible for issues resulting from declined recommendations. - Existing Conditions
By approving the estimate, the customer acknowledges acceptance of existing site conditions including surface wear, cracking, drainage issues, grading conditions, oil stains, and pavement deterioration.
Veteran Asphalt shall not be responsible for conditions not specifically addressed within the approved scope of work. - Payment Terms
A deposit may be required prior to scheduling work.
Unless otherwise agreed in writing, final payment is due immediately upon completion of services.
Invoices unpaid after 30 days may incur a late fee of 1.5% per month (18% annually). The customer agrees to pay any reasonable collection costs or attorney fees incurred in collecting unpaid balances.
Credit card payments may be subject to processing fees.
Veteran Asphalt reserves the right to suspend or delay work if payment terms are not met. - Pricing & Estimate Validity
Pricing is subject to change prior to acceptance due to changes in labor, fuel, or material costs.
Unless otherwise stated, estimates are valid for 30 days from the date issued. - Scheduling & Weather
All asphalt sealing work is weather dependent.
Rain, low temperatures, humidity, or other weather conditions may require delays or rescheduling. Veteran Asphalt is not responsible for scheduling delays caused by weather or conditions outside of its control. - Customer Responsibilities
The customer is responsible for:
Removing all vehicles, trailers, equipment, basketball hoops, and other obstacles from the work area prior to service
Keeping all vehicles and foot traffic off sealed surfaces until fully cured
Turning off sprinkler systems during and after application as directed
Providing accurate property boundaries and access information
Informing Veteran Asphalt of any known underground utilities, irrigation systems, or drainage structures
Veteran Asphalt shall not be responsible for missed areas due to blocked access or obstacles left within the work area. - Access Delays & Return Trips
If Veteran Asphalt is unable to complete work due to blocked access, vehicles left on site, locked gates, customer scheduling conflicts, or other customer-caused delays, additional charges may apply for return trips or rescheduling. - Underground Utilities & Property Conditions
The customer is solely responsible for identifying underground utilities, irrigation systems, invisible fencing, drainage systems, or other buried structures prior to work beginning.
Veteran Asphalt shall not be liable for damage to unidentified underground systems or hidden property conditions.
Heavy equipment and work vehicles may cause incidental damage to landscaping, grass, curbing, sprinkler systems, sidewalks, or adjacent surfaces while work is being performed. - Photographs & Marketing
Veteran Asphalt may photograph work areas before, during, and after service for documentation, quality control, marketing, and social media purposes.
Photos may be used in promotional materials unless the customer requests otherwise in writing prior to the start of work. - No Warranty
Unless otherwise stated in writing, all services are provided without warranty, express or implied.
Sealcoating is considered preventative maintenance and not a permanent repair solution.
Veteran Asphalt does not guarantee against future cracking, fading, surface wear, drainage issues, or pavement failure. - Limitation of Liability
Veteran Asphalt’s total liability for any claim related to services performed shall not exceed the amount paid by the customer for the specific services giving rise to the claim.
Veteran Asphalt shall not be liable for indirect, incidental, or consequential damages including loss of use, staining, tracking, or damage caused by premature use of sealed surfaces. - Notice of Claims
Any claim relating to completed work must be submitted in writing within 7 days of discovery.
The customer must allow Veteran Asphalt the opportunity to inspect the work before any third-party repairs or corrections are performed.
Failure to provide notice may result in waiver of claims. - Force Majeure
Veteran Asphalt shall not be responsible for delays or failure to perform due to circumstances beyond reasonable control, including weather conditions, equipment failure, labor shortages, supply chain disruptions, acts of God, or governmental restrictions. - Governing Law
These Terms & Conditions shall be governed by the laws of the State of Michigan.
Any disputes arising from services provided by Veteran Asphalt shall be handled in Oakland County, Michigan.
SERVICE-SPECIFIC TERMS
SEALCOATING
Sealcoating is a preventative maintenance application intended to protect asphalt from UV rays, oxidation, moisture, and normal weather exposure.
Sealcoating does not repair structural pavement damage, potholes, base failure, drainage problems, or severe cracking.
Existing cracks, patches, and repairs may remain visible after sealing.
Color and finish may vary depending on asphalt age, porosity, temperature, weather, oil stains, and previous repairs.
Vehicles and foot traffic must remain off sealed surfaces for a minimum of 24 hours or as otherwise directed.
Premature use may result in tire marks, scuffing, tracking, or surface damage for which Veteran Asphalt is not responsible.
Sealcoat material may temporarily transfer onto tires or shoes if surfaces are used before full cure.
Sprinkler systems must remain off for at least 48 hours following application.
Sealcoating performed late in the season may experience accelerated wear due to winter weather, freeze-thaw cycles, road salt, snowplows, and deicing products.
CRACK FILLING
Crack filling is a maintenance service designed to reduce water penetration into asphalt surfaces.
Crack filling is not a structural repair and will not prevent future cracking.
Some shrinkage or settling of crack filler may occur over time.
Severely deteriorated areas or alligator cracking may require more extensive repair work beyond standard crack filling.
